The rights of all text, pictures, and other content created by users is retained by their creators, however the service provider is allowed to use and file information and data and make changes that are necessary for the service or the study, however other rights are not transferred from the users, unless specifically otherwise agreed. The responsibility of this content lies with the user, who has produced it to the service. The service provider has the right to remove any material when it deems it necessary.
No guarantees of the functioning of the service are given. The users are themselves responsible for their actions in the service and they should estimate the reliability of the service before engaing with it. The Site can under no circumstances be liable for damage that is caused to the user. The user may not store any information or data in the service, and expect it to remain there.
The Site has the right to remove any users from Montres Publiques Auction and terminate their right of use of the service without any specific reason and without being liable for compensation.
Transactions on Montres Publiques Auction are all facilitated by Montres Publiques Auction. Once the auction is complete the winning bidder is responsible for paying the final price and agrees to do so by accepting these Terms, this is a legally binding agreement. If the winning bidder refuses or is incapable of doing so they may be blacklisted from Montres Publiques without notice and further action can be taken depending on the circumstances. In addition, if the winner of an auction fails to pay for it within 24 hours, it may be considered forfeited. Upon confirmation of the payment Montres Publqiues will ship the product to the address provided by the winning bidder using the service of the Site's choice, within 48 hours of payment confirmation. Generally, timepieces have not been serviced unless specifically stated and do not come with box or papers unless specifically stated. Timepieces are sold directy by Montres Publiques Auction or third-parties as specified under each listing. Moreover, the Montres Publiques Auction website may be updated at any time, including the individual listings and these terms.
Those interested in auctioning their own timepieces/products on Montres Publiques Auction should contact the team at email@example.com. The Site charges sellers a fee of 12% and requires sellers to send their products, under consignment, to Montres Publqiues Auction for checking/authentication and eventual auctioning.
The period of consignement would be decided upon on an individual basis, based on upcoming auctions. Products will be inserted into the schedule of upcoming auctions. Shipping the watch/product in for authentication is at the cost of the seller, if the product is not deemed acceptable to go forward in the process it will be returned to the seller at no cost. The 'handling fee' is $75, this is the cost of having the watch checked/authenticated. The handling fee is an upfront cost, paid prior to commencing the auction process and shipping the watch to Montres Publiques Auction for checking/authentication.
Once the product is cheked/authenticated, Montres Publiques Auction will prepare multi-media to promote the upcoming sale of the product and provide potential purchasers with suitable information on the lot. If/when the product is sold, Montres Publiques Auction will handle shipping/delivery of the product to the purchaser directly (choosing a service provider at its discretion - see Shipping below) and afterwards send the funds to the seller - paying the cost of shipping itself, upfront.
As such, the seller receives 88% of the final price (less the 12% service fee, not including the buyer's premium and shipping fee). Montres Publiques Auction charges a 6% buyer's premium and a $32 flat fee for global shipping. If the product is not sold by Montres Publiques Auction, it will be returned to the seller at no cost, meaning the seller pays only the initial shipping cost and handling fee of $75. All lots on Montres Publiques Auction are no reserve, meaning any watch sold by a third-party will also have a starting bid of $1. Montres Publiques Auction will never make any guarantee of a reaching a specific sale price.
We ship all of the lots using either Canada Post/USPS in North America and DHL Express internationally. We may use other depending on circumstances.
In the case of a dispute, Montres Publiques Auction maintains a strict no returns policy, unless something is demonstrably different that what was indicated in the description of the auction lot. Montres Publiques Auction also does not offer any warranty or repair services but can assist in finding reliable watchmakers globally.
This Website is provided "as is," with all faults, and Montres Publiques, Inc. express no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you. The website and these terms are updated continually.
In no event shall Montres Publiques, Inc., nor any of its officers, directors and employees, shall be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. Montres Publiques, Inc., including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.
You hereby indemnify to the fullest extent Montres Publiques, Inc. from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.
If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
Montres Publiques Auction/Montres Publiques, Inc. is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.
Montres Publiques Auction/Montres Publiques, Inc. is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
These Terms constitute the entire agreement between Montres Publiques Auction/Montres Publiques, Inc. and you/the user in relation to your use of this Website, and supersede all prior agreements and understandings.
